Electronic land certificates in Indonesia: Permen ATR/BPN 3/2023 in English

Indonesia is moving its land register from paper to electronic records, and the certificate a Bali buyer receives is increasingly an electronic one. The regulation that governs it replaced Permen ATR/BPN 1/2021 on electronic certificates (Permen ATR/BPN 3/2023 art. 46) and was set on 16 June 2023 and promulgated on 20 June 2023 (Permen ATR/BPN 3/2023, signature and promulgation block).

What the electronic certificate is, and what it is not
A Sertipikat-el is a certificate issued through the electronic system as an electronic document, whose physical and legal data are stored in the electronic land book (BT-el) (Permen ATR/BPN 3/2023 art. 1(9)). It takes effect once it is signed electronically (Permen ATR/BPN 3/2023 art. 17(3)). The record, not the document, is the authority: if a printed copy differs from it, the data in the ministry's database prevails (Permen ATR/BPN 3/2023 art. 21(2)). Each certificate carries a QR code that confirms authenticity and shows the certificate's status (Permen ATR/BPN 3/2023 art. 20(4)), and every plot has a 14-digit plot identification number: province, regency, plot number and a final digit for surface, airspace, underground or strata (Permen ATR/BPN 3/2023 art. 13(2)).
For a buyer that changes the old advice. Holding the paper used to be the point; now the point is checking the record and the edition. When a right changes hands the system issues a new edition; the earlier edition stops being valid and becomes registration history (Permen ATR/BPN 3/2023 arts. 30, 40(2)-(3)) — so a seller showing an earlier edition is showing history, not the current title. The foreigner’s account
The certificate is reached through a single land account, opened on the passport number, for a foreign individual (Permen ATR/BPN 3/2023 art. 19(5)(b)). A paper copy remains available: an official copy printed on special secure paper at the land office, for a holder who cannot use the system, cannot access it, or asks (Permen ATR/BPN 3/2023 art. 20(1)-(3)). For a right with a term, the end date is counted from the date the right is booked (Permen ATR/BPN 3/2023 art. 17(4)) — the date to diarise for an extension.
The sale, in the new system
After the deed is signed, the PPAT submits it through the electronic system within 7 working days of signing, with identity documents, any transfer permit, and proof of BPHTB and income tax paid (Permen ATR/BPN 3/2023 art. 25(2)-(3)). The land office checks it within 5 working days, after which the deed is treated as accepted if not examined (Permen ATR/BPN 3/2023 art. 26(3)-(4)). Some entries are recorded on the register without a new edition: blocks, seizures and disputes, abandoned-land status, status quo, a PPJB or lease, and the end of a right (Permen ATR/BPN 3/2023 art. 31(1)) — which is why the information services matter. They cover a certificate check, a land-registration statement (SKPT) and land-value information, issued as electronic documents with an electronic seal (Permen ATR/BPN 3/2023 art. 32).
Where data are incomplete or a plot is in dispute, the certificate is held back until the note is removed (Permen ATR/BPN 3/2023 art. 18(4)). A seller who says the electronic certificate is “still being processed” may be describing exactly that note; ask what is recorded on the validation sheet.
Paper certificates
Paper records are converted village by village, or when the holder applies for a registration service such as a transfer (Permen ATR/BPN 3/2023 art. 33(2)). When that happens at a transfer, the paper certificate is kept as part of the registration file (Permen ATR/BPN 3/2023 art. 39(3)) and the buyer receives the electronic edition. A paper certificate is therefore not invalid today; it is a record the next transaction will convert. The holder must read the notices in the 'perhatian' box at the foot of the certificate (Permen ATR/BPN 3/2023 art. 43).
