Taxes and transfer costs: which are statutory and which are a negotiation

Most Bali cost tables mix statutory rates with market estimates and present both with the same confidence. These are the ones with an article number behind them.

There are two Bali cost calculators that do this job well, and we are not going to build a third. We would rather tell you that ownpropertyabroad.com and balipropertyrules.com both have one, and that between them they cover acquisition duty, notary fees, due diligence costs and company setup.

What this page does instead is the thing neither of them does: separate the charges that come from a statute, and therefore have a number we can show you, from the ones that come from a negotiation and therefore do not.

The distinction that matters

Four categories of cost arrive in a Bali purchase, and only two of them are statutory. Mixing them in one table — which is the norm — makes market estimates look as solid as statutory rates.

Acquisition duty, properly

BPHTB is duty on acquiring a land or building right, and the first thing to establish is whether what you are acquiring is on the list at all. Article 44(3) of Law 1/2022 names six rights: hak milik, hak guna usaha, hak guna bangunan, hak pakai, strata title and hak pengelolaan. Hak sewa is not among them, which is why a pure leasehold sits outside this charge.

Where it does apply, three provisions set the arithmetic:

This is why a national figure for Bali does not exist. The rate and the threshold are both set by the regency or city. Bali has nine regional governments, and the villa in Canggu and the villa in Ubud are in different ones. Which one you are buying in decides which by-law sets your bill, and we do not publish a per-regency figure because we have not read each regency’s by-law.

The seller’s tax

PP 34/2016 article 2(1) sets final income tax on a transfer of land or buildings at 2.5% of the gross transfer value, with two carve-outs: 1% for simple houses and simple flats transferred by a taxpayer whose main business is transferring property, and 0% for transfers to government bodies and certain state enterprises under the public land acquisition legislation.

It is the seller’s charge. Whether it ends up in the price is a negotiation, and it is worth settling in writing early — a seller who has not budgeted for it will discover it at the deed, which is a bad moment to reopen a price.

What NJOP is, since three of the rules above turn on it

NJOP appears in the acquisition-duty base, in the annual tax base and in the substitution rule, and it is almost always used without being defined. Law 1/2022 (HKPD) art. 1(36) defines it as the average price from arm's-length sales: the average price obtained from sale transactions occurring at arm's length — and where no such transaction exists, a value set by comparison with similar objects, by new acquisition value, or by a substitute NJOP.

Two consequences for a buyer. It is an administratively determined value rather than a market appraisal, so it is generally below what you pay. And because article 46(3) substitutes it where a declared price is lower, it operates as a floor under the duty: declaring a low price does not produce a low bill, it produces the NJOP.

The annual charge

PBB-P2 is capped at 0.5% by article 41(1) of Law 1/2022 and set by by-law. It is assessed on NJOP, the tax object sales value used for the tax, which is not the same thing as what you paid and is generally lower. Article 41(2) requires a lower rate for food and livestock production land, which is a reminder that the designated use of land has tax consequences quite apart from the planning ones. The annual tax as Denpasar and Tabanan actually set it, with a worked example.

What two by-laws actually set

Until September 2026 every figure on this page was a national ceiling or floor, because no Bali by-law had been obtained. Two now have: Kota Denpasar Perda 5/2023, which covers Sanur, and Kabupaten Tabanan Perda 13/2023, both read in Indonesian from each region’s own legal database. Badung’s and Gianyar’s — Canggu, Seminyak, Uluwatu, Ubud — could not be obtained, so those stay at the ceiling.

For an ordinary purchase the two agree exactly: 5% on the acquisition value after a tax-free IDR 80 million — the national ceiling and the national floor, adopted as they stand. They part company on inheritance. Denpasar charges 0% when a child or spouse inherits (Denpasar Perda 5/2023 art. 13(2)); Tabanan charges its normal rate but lifts the tax-free value for immediate family to IDR 3 billion (Tabanan Perda 13/2023 art. 12(5)). For a family planning to pass a property on, the regency is not a detail. What each structure does on death.

On a sale the two taxes fall on different parties at different moments. Taxes on a sale, both sides and when.

What we will not put in the table

Legal fees, due diligence costs and agency commission are all real and all material. None is set by an instrument we could read, so none of them gets a number here.

A correction. Until 26 September 2026 this paragraph also listed notary and PPAT fees as unregulated. They are not: the PPAT’s fee is capped at 1% of the transaction price stated in the deed, witnesses included (PP 37/1998 art. 32(1)), and a notary’s fee by the deed’s value (Law 30/2004 art. 36(3)). We had read the PPAT regulation and missed its article 32. The caps, with worked figures.

On commission specifically: Agency commission in Bali is commonly quoted between 2.5% and 5% of the transaction, with 5% the figure most often cited. No Indonesian regulation sets it; it is negotiated, and it is market practice rather than law. It deserves to be labeled as practice rather than sat in a table between two statutory rates, where it will be read as equally solid.

PT PMA setup and running costs are quoted by service providers and vary by scope. What is statutory is the investment floor: Perka BKPM 4/2021 art. 12(2) requires more than IDR 10 billion of total investment, excluding land and buildings, per five-digit KBLI line per project location — with the property carve-out at article 12(3)(e) that measures the same threshold including land and buildings for a whole building or an integrated complex.

The cost nobody puts in a calculator

Every charge above is a percentage of the price, and together they are a modest fraction of it. The remaining term on a lease is not a fraction of the price. It is a multiplier on what every year of ownership costs you, and it swamps the entire transfer-cost table.

Run the two listings you are comparing through the calculator before you spend much time on stamp duty. If one costs twice as much per year of use as the other, no arrangement of the costs above will close that gap.

What is BPHTB?

Bea Perolehan Hak atas Tanah dan Bangunan — duty on the acquisition of a land or building right, payable by the acquirer. Law 1/2022 article 47(1) caps it at 5% and leaves the operative rate to regional by-law. Article 44(3) lists the rights whose acquisition is caught: hak milik, HGU, HGB, hak pakai, strata title and hak pengelolaan.

Is a leasehold purchase subject to BPHTB?

A lease is not on the article 44(3) list, because hak sewa is not a land right whose acquisition is registered — it is a contract. That is why the cost calculators that rank for Bali queries put acquisition duty at zero for leasehold, and on that specific point they are right. Whether other charges arise on a lease is a question for an Indonesian tax adviser on your actual documents.

What rate will I actually pay?

The one your regency or city sets by by-law, which is why a figure quoted to you as 'the Bali rate' is at best the rate in one of Bali's nine regional governments. Law 1/2022 article 47(2) says the rate is set by Perda, and article 46(8) says the same about the tax-free threshold. We publish the national ceiling and name the body that sets the real number rather than printing one and calling it national.

How does the tax-free threshold work?

Article 46(4) requires the regional government to set a tax-free acquisition value (NPOPTKP) as a deduction from the base. Article 46(5) puts a floor under it: at least IDR 80 million for a taxpayer's first acquisition in that region. A regional government may set it higher. For inheritance or bequest between close relatives, article 46(6) raises the floor to IDR 300 million.

What does the seller pay?

Final income tax on the transfer: 2.5% of the gross transfer value under PP 34/2016 article 2(1)(a). The rate is 1% for simple houses and simple flats transferred by a taxpayer whose main business is property transfer, and 0% for transfers to government bodies under the public acquisition legislation.

What about the annual tax?

PBB-P2, land and building tax, capped at 0.5% by Law 1/2022 article 41(1) and again set by regional by-law. It is assessed on NJOP, the tax object sales value, rather than on what you paid.

Are notary and PPAT fees regulated in Indonesia?

Yes, by ceilings. PP 37/1998 article 32(1) caps the PPAT's fee at 1% of the transaction price in the deed, witnesses included, and Law 30/2004 article 36(3) caps a notary's fee by the deed's value: 2.5% up to IDR 100 million, 1.5% up to IDR 1 billion, and at most 1% above that. Earlier versions of this page said no regulation set them; that was wrong, and was corrected on 26 September 2026.
